TL;DR — what you’re agreeing to
Be cool. Don’t break things. We can help.Plain English: Gaana Bta is a free AI music-search engine. We don’t host the songs — we point you to where they live. Use it for personal listening or making reels. Don’t scrape, don’t ban-evade, don’t impersonate, don’t try to break the AI. We can suspend accounts that do.
- This is a beta. Some features will work, some won’t, and some may disappear overnight. By using the beta you agree your usage data and feedback help us improve the platform.
- Free and ad-supported. The core service is free. We show advertisements to help cover our operating costs.
- We don’t own the music. Spotify, YouTube, Apple Music, JioSaavn, Gaana, Wynk handle that. Their terms apply when you open their links.
- Your prompts are yours. Anonymised aggregates may improve the service — an in-app opt-out toggle isn’t built yet; email us and we’ll opt you out manually.
- We can suspend or refuse accounts — for abuse, spam, ban-evasion, scraping, or signing up with a disposable / temporary email address.
- Indian law applies. Disputes go to Delhi courts. Have a complaint? Email us first — we want to fix it.
Acceptance & legal status
Click-wrap binding under § 10A, IT Act 2000.These Terms of Service (“Terms”) form a legally binding electronic contract between you (“you”, “User”) and the operator of gaanabta.com (“we”, “us”, “Gaana Bta”), enforceable as a click-wrap agreement under § 10A of the Information Technology Act, 2000.
No company has been incorporated yet. Gaana Bta is currently operated on a sole-proprietorship basis by an individual operator resident in India — which Indian law permits. If the beta succeeds and a company (or LLP) is incorporated to run the service, these Terms will be novated to that entity and we will notify you per § 15 (Changes). If it doesn’t, the service may be discontinued (§ 3 — Beta release).
By creating an account, ticking the consent box, or simply continuing to use the service, you confirm you have read, understood, and agree to be bound by these Terms and the linked Privacy Policy. If you do not agree, you must not use the service.
We also operate as an Intermediary under § 2(1)(w) of the IT Act, 2000 and the IT (Intermediary Guidelines) Rules, 2021. The due-diligence requirements of Rule 3 apply; see § 12 (Grievance Officer) of our Privacy Policy.
What the service is
AI-powered song discovery with deep-links out.Gaana Bta is an AI-powered music-search service. You describe a moment, lyric, or vibe in plain words — our model returns matching songs from a metadata catalogue, along with deep-links to platforms that play the audio.
The service includes the website at gaanabta.com, the AI search engine, our admin and support tooling, and any communication channels we use to talk to you. We do not stream or host any audio — on desktop or on mobile — and we hold no music streaming licences. Playback always happens on the third-party platform you deep-link out to.
Beta release — read this first
Early access. Things will break. Your feedback shapes v1.Gaana Bta is currently offered as a public beta release. That means you are getting early access to a product that is still being built, in exchange for helping us make it better. By creating an account or using the service during the beta, you specifically acknowledge and agree that:
- Some functionality may work, some may not. Features may be incomplete, unstable, unavailable in your region, or removed, changed or reset (including saved data such as playlists, library items, and preferences) at any time without notice.
- Your usage data and feedback will be used to improve the platform. Search prompts, playback behaviour, feature usage, bug reports, support tickets, and any feedback you submit may be analysed — in anonymised / aggregated form wherever feasible — to debug, tune, and develop Gaana Bta. Details and opt-outs are in the Privacy Policy.
- Feedback is licensed to us. If you send ideas, suggestions or bug reports, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or compensation. We’ll take the thanks, though.
- No service levels during beta. We give no uptime, data-durability or support commitments while the beta runs. Export anything you can’t afford to lose.
- The beta may end, change, or be gated at any time. We may convert beta features into paid features, discontinue them, or require re-registration when we exit beta — with notice per § 15 (Changes) where the change is material.
- The whole service may be shut down at any time. Gaana Bta is a market experiment: if it finds its audience we will continue building it; if it doesn’t, we may discontinue the service — in whole or in part, temporarily or permanently — at our sole discretion. Where reasonably practicable we will give advance notice and a window to export your data; we owe no compensation for discontinuation of a free beta service.
Your account
13+, real email, you’re responsible for security.To create an account you must:
- Be at least 13 years old. Under § 11 of the Indian Contract Act, 1872 a minor cannot ratify a contract — Users under 18 additionally need a parent or guardian’s verifiable consent under § 9 of the DPDP Act, 2023. During the beta we rely on your self-declaration of age at sign-up (we don’t collect your date of birth yet); creating an account is your confirmation that you meet these requirements. An age check + parental-consent flow is on the beta roadmap.
- Provide a real, working email — you’ll need it for verification, support, and security alerts. Disposable / temporary email addresses are not allowed. We may reject sign-ups from — and suspend accounts registered with — known temporary-mail providers, and we maintain a blocklist of such domains.
- Pick a strong password. We hash and salt it; we never see it in plain text.
- Use it for yourself. One person, one account. No selling, sharing, or letting others use your login.
You are responsible for keeping your password safe and for everything that happens under your account. If something looks fishy — turn on 2FA, change your password, and tell us.
We reserve the right to refuse, limit, or block any registration or account at our reasonable discretion — including (without limitation) accounts using disposable email addresses, automated / bot sign-ups, duplicate accounts, or accounts we reasonably believe threaten the security or integrity of the platform. Where lawful and practical, we’ll tell you why and how to appeal (§ 10 — Suspension & termination).
Free beta & advertising
Everything is free right now. Ads keep the lights on.During the beta, everything on Gaana Bta is free. There are no paid plans, no subscriptions, and no payments of any kind right now — we don’t collect payment details and we don’t issue invoices.
If we ever introduce paid plans, we will update these Terms first and give every registered user at least 30 days’ notice by email (§ 15 — Changes). Nothing will be charged without your explicit opt-in at that time.
How you can use the service
Personal listening, reel-making, social posting.You can use Gaana Bta’s search results for:
- Personal listening — finding what to play on any platform you have access to.
- Reels, shorts, status updates — sharing the deep-links and timestamps we surface, for non-commercial creator content.
- Discovery threads — sharing screenshots of our search results in articles, social, or chats.
When in doubt: use Gaana Bta to find the song; deal directly with the platform/label for the right to use it.
What you can’t do
No scraping, no impersonation, no ban-evasion, no AI abuse.The short list. Doing any of these can get your account suspended without warning. Several of them are independently offences under the IT Act, 2000 (§§ 43, 65, 66, 66C, 66D, 67):
Don’t hit our API outside personal rate limits. Don’t scrape the catalogue. Don’t resell our metadata. (§ 43(b) IT Act.)
Don’t pretend to be someone else — another user, an artist, a label, or us. (§ 66D IT Act.)
If we suspend you, don’t make new accounts to come back. We re-suspend and may block your IP range.
Don’t jailbreak the model, extract training data, or generate harmful content via prompts.
No hate speech (§ 153A IPC / § 196 BNS), threats, CSAM (§ 67B IT Act / POCSO), or copyright-infringing material in prompts or tickets.
Don’t try to extract our models, embed APIs, or interfere with how the service runs. (§ 65 IT Act.)
Pursuant to Rule 3(1)(b) of the IT (Intermediary Guidelines) Rules, 2021, you must not host, display, upload, modify, publish, transmit, store, update or share any information that falls within the categories listed therein.
AI search — the fine print
Results are suggestions, not endorsements. Mistakes happen.Our AI scores songs by how well their meaning matches your prompt. It’s good — it’s not perfect. Results are suggestions, not endorsements. We do not warrant:
- That a suggested song will be available on your platform of choice.
- That deep-link timestamps will always be correct (platforms shift their IDs).
- That the lyric meaning we read is the only valid reading.
- That every song in our catalogue has been licensed for every region.
We have not built our own AI model. Gaana Bta uses existing third-party AI model providers to interpret prompts and match songs. The quality, biases, and limitations of those underlying models are outside our full control.
Translations can shift meaning. Songs and prompts cross languages — and translated lyrics or prompts can change context or meaning in ways we don’t always support or catch. A match that works in one language may read differently in another; treat cross-language results with extra care.
AI-assisted support. When you contact us or raise a support ticket, you agree that your messages may be processed by AI (via our third-party model providers) to summarise, categorise, and analyse them, and that some replies you receive may be drafted or sent automatically by AI. Automated replies are provided for speed, not as final decisions: you can always reach a human by replying to the message or emailing grievance@gaanabta.com, and — wherever you use the service from — an automated reply never reduces your statutory rights or the grievance timelines under the IT Rules 2021 (acknowledgement in 24 hours, resolution in 15 days).
When the AI gets it wrong, tell us — every feedback ticket goes into the eval set we use to make the next version better.
Intellectual property & DMCA / Copyright takedown
We own the platform. You own your prompts. § 52 Copyright Act.The Gaana Bta brand, code, AI models, UI, copy, design system, and the curated metadata catalogue are owned by the operator of gaanabta.com and our licensors. You receive a limited, non-exclusive, revocable, non-sublicensable licence to use the service per these Terms.
Your content (prompts, saved boards, ticket messages) remains owned by you. By submitting it, you grant us a worldwide, royalty-free licence to host, process, and display it for the purpose of running the service. Anonymised aggregates may improve future model versions — see Privacy Policy → AI for opt-out.
Music belongs to labels & artists. We do not claim rights to any song, lyric, album art, or recording — we only point you to where they are hosted.
Copyright complaints (Notice & takedown). If you believe a deep-link surfaced by us infringes your copyright, send a written notice to copyright@gaanabta.com containing the particulars required by Rule 75 of the Copyright Rules, 2013 (your identity, the work allegedly infringed, the URL, a good-faith statement, and an undertaking under § 52(1)(c) of the Copyright Act, 1957). We act on valid notices within 36 hours, in line with Rule 3(1)(d), IT (Intermediary Guidelines) Rules, 2021.
Suspension & termination
We can pause / end your account. You can leave anytime.We may suspend or terminate your account if you:
- Violate these Terms or our acceptable-use rules;
- Engage in fraud, chargebacks, or abuse of the support system;
- Pose a security threat to other Users or the platform itself;
- Registered with — or switch to — a disposable / temporary email address, or an email domain on our abuse blocklist;
- Are the subject of a binding Government order under § 69A of the IT Act, 2000.
During the beta we may additionally suspend, reset, or restrict accounts where reasonably necessary to protect the stability of the platform — and we may discontinue the service itself, in whole or in part, at any time (see § 3 — Beta release). Where practicable we’ll give notice and time to export your data before a permanent shutdown.
We will usually tell you first and give you a chance to fix the issue. Severe violations (CSAM, threats, scraping at scale) skip the warning. You can end your account at any time from Profile → Data & export. Upon termination, retention periods in our Privacy Policy apply.
Warranty, liability & indemnity
Service comes “as is”. Our liability is capped.Gaana Bta is provided “as is” and “as available”. We work hard to keep it up, secure, and accurate — but we cannot promise zero downtime, zero bugs, or that every search result will fit your taste perfectly. To the maximum extent permitted by Indian law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in this clause limits liability that cannot be limited under Indian law, including liability for gross negligence, fraud, wilful misconduct, death or personal injury caused by our negligence, or consumer rights under the Consumer Protection Act, 2019.
Indemnity. You agree to indemnify and hold us harmless against any third-party claim arising out of your breach of these Terms, your User Content, or your infringement of any law.
Governing law, disputes & jurisdiction
Indian law. Exclusive Delhi courts. Email us first.These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.
Subject to the consumer’s right under the Consumer Protection Act, 2019 to seek redress before the consumer forum at their place of residence, the parties agree that the courts at New Delhi, India shall have exclusive jurisdiction over any dispute, controversy or claim arising out of or relating to these Terms or the service (enforceability of exclusive-jurisdiction clauses upheld by the Supreme Court of India in Swastik Gases v Indian Oil Corporation, (2013) 9 SCC 32). Any legal proceeding or complaint concerning the service must be registered / instituted in Delhi.
Mandatory first step: before filing any proceeding, please email legal@gaanabta.com describing the dispute. We will engage in good-faith discussions for 30 days. If the dispute remains unresolved you may, at your option, refer it to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in New Delhi, in English.
Force majeure
No liability for things outside our reasonable control.Neither party is liable for any failure or delay in performance to the extent caused by events beyond its reasonable control — including acts of God, war, riots, terrorism, pandemics, internet/ISP outages, government orders (including under § 69A IT Act), or industry-wide labour action.
Miscellaneous
Severability, assignment, notices, entire agreement.- Severability. If any provision is held invalid by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
- No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger / sale of substantially all assets.
- Notices. Legal notices to us must be sent to legal@gaanabta.com with a copy by registered post to our address in § 1 of the Privacy Policy. Notices to you are deemed delivered when emailed to your registered address.
- Entire agreement. These Terms, together with the Privacy Policy and any feature-specific terms presented in-product, constitute the entire agreement between you and us regarding the service.
Changes to these Terms
30-day email notice for anything material.We may update these Terms as the service grows or the law changes. For material changes (anything that meaningfully changes your rights, pricing, or how you use the service), we will email every registered User at least 30 days before the change takes effect.
Continuing to use Gaana Bta after a change takes effect constitutes acceptance of the new Terms. If you do not agree, cancel your account before the effective date — we keep past versions at gaanabta.com/legal/archive.
